This Privacy Policy ( “Privacy Policy”) is made between Binogi Canada Ltd. ("Binogi", "We", "Us"), email: support@binogi.ca, and you, the User ( "you" ) pertaining to our collection and handling of the information that you submit when creating an account on www.binogi.ca ( the "Website", the "Service").

1. General

By creating an account for the use of the Service, you agree to this policy in accordance with section 3 ( “Consent”). If you do not agree with this policy, you will not be able to use the Service.

2. Personal Data

2.1. What is Personal Data?
Personal Data is any information relating to an identified or identifiable living natural person, such as a name, email address or IP address. The Personal Data we collect and the purposes for said collection are described in this Privacy Policy.

When using the Service, we collect personal information for several purposes. To use the Service, you must first read and accept this Privacy Policy.

All personal data is stored on servers located in Canada. The handling of your information is in accordance with PIPEDA, the Privacy Act, British Columbia’s Freedom of Information and Protection of Privacy Amendment Act, Nova Scotia’s Personal Information International Disclosure Protection Act, Quebec’s Act Respecting Access to Documents Held by Public Bodies and the Protection of Personal Information. If you use the Service through your school, your school is responsible for the processing of your Personal Data while Binogi is responsible for the administrative processing of this data.

2.2. What Personal Data do we process?
We collect and use the following Personal Data to provide and maintain an efficient and safe Service:

  • full name
  • email
  • password in encrypted form
  • IP address (the IP address is a unique address for a technical device such as a computer, a tablet or a mobile phone)
  • ID from a Single Sign on (SSO) provider, if any

When you use the Service, some information is also automatically gathered, such as:

  • information pertaining to how you use the Service
  • how often you log in
  • the features you use and how you navigate between the various functions of the Service
  • content that you publish, create, upload and/or contribute to the Service
  • technical data such as URLs that let you access the website
  • your IP address and type of browser you are using

Please note that we need the above information to be able to offer you Service. If we can not collect this information, we can not provide the Service.

2.3. What do we use your Personal Data for?
To manage your account, and to provide the Service, we need to process certain Personal Data.

For the personalization of the Service: to provide a personalized experience with follow-up, results and recommendations

Eligibility and Access: to ensure that the right people have access to the Service and to prevent abuse of the Service

Support: When contacting our support team, we may collect personal information that may be needed to help you and to be able to get in touch with you. We may also contact you about the information associated with your user account that you specified for this purpose

Updates, information e-mails: to send messages and news via e-mail or other media; this includes all information about the platform's continued development

Analysis and improvement: to improve the Service and develop new Services and products

To meet legal requirements: to fulfill the obligations and requirements of applicable law

2.4. What rights do you have?
You have the right at any time to ask us what Personal Data belonging to you is held by us, where this Personal Data has been collected and who the Personal Data has been forwarded to. You have the right to information for free, without having to provide any justification.

You can request that we correct, block or delete your personal data at any time if the information is incorrect.

To exercise the above rights, or if you have questions about our approach, your rights under the relevant legislation or if you wish for your information to be deleted, please contact us on our customer chat or at the following address: support@binogi.ca. To ensure that you get a prompt response, please include your full name in your message and, if applicable, the email address you used to register.

If you request that we delete your account, we will immediately lock the account and remove your Personal Data within 90 days.

You can reactivate your account and gain renewed access to the Service until such time that your personal data is deleted. We regularly cull inactive accounts so that no Personal Data is kept with us when you are no longer using your account.

We will promptly notify you upon detection of unauthorized access, destruction or alteration of your Personal Data, and attempts thereto. It is important to distinguish between regular and sensitive Personal Data. Sensitive data includes ethnic origin, political affiliation, religious or philosophical beliefs, trade union membership and data concerning health or sexual preferences. We will never gather or collect sensitive data.

3. Consent

If you click on the [ "I accept that my personal data is processed according to the Privacy Policy and Terms of Service"] and create a user profile for the Service, you acknowledge and agree herewith the processing of your personal data under this policy.

4. Cookies

When you use our website, "cookies" are stored on your computer. Cookies are small text files stored on your computer where personal settings can be saved and allow monitoring of what visitors do on the site. Cookies cannot run programs or install viruses on your computer. The purpose of the usage of cookies is to make our Service more user friendly and efficient.

This website uses the following cookies: Session cookies, Permanent cookies, Third party cookies from Google Analytics.

Session cookies are automatically deleted when the browser is closed. They store a so-called session ID. This allows you to assign different requests from your browser to the shared session. When you log off or close your browser session, cookies are deleted. Permanent cookies are deleted after a certain period, which can vary depending on the cookie. In the browser's security settings, you can at any time remove permanent cookies.

5. Legal Requirements and Liability

We may, where appropriate, provide, store and use your personal data within Canada as a result of legal requirements or to detect, prevent and combat fraud and/or other criminal activity, or to protect you and other users, this also in connection with an investigation, provided that this is required by the laws of Canada.

6. Links to other websites

Please note that you may be redirected to other websites when you use our website. On these websites, the processing of your Personal Data is beyond our control. These websites’ terms of Service or privacy policies will address how information is collected and processed on said websites.

7. Personal Data Security

Physical Security: Production servers are in a locked and alarmed room. The server room is monitored round the clock and has a security system with separate verification systems and video surveillance. All access is logged.
Transmission and communication: All communication between our systems and users are encrypted using SSL (Secure Socket Layer).
Password Protection: The login process is fully encrypted, meaning that no information is sent as unencrypted text. User passwords are stored in an encrypted format.
Login and Traceability: All logins and login attempts are recorded with time and IP address. This is true for the secure connection to the server. After a certain number of failed attempts to log in, the server will temporarily block the IP address. This temporary block is to ensure accounts are protected.
Backup: For all critical data, the server creates backups daily in several steps according to a rotation schedule to ensure that no data is lost. The backups are stored safely in a different location than the original data.
Firewall and malware protection: A firewall and a number of technical, administrative and organizational measures restricting remote access protect our servers from unauthorized access and malicious code, destruction and modification.

8. Miscellaneous

Change of ownership: If the ownership of our company changes, we may transfer your information and user data to the new owners so that they can continue to provide the Services. The new owners will continue to fulfill the requirements and obligations set out in this Privacy Policy.

Policy changes: If we make changes to this Privacy Policy, you will be informed of these changes on the website. If there are significant changes you will receive a special notification, depending on what is appropriate under the circumstances. If required by law, we will request your consent.

In order to provide our service to our users, we have some subcontractors who access certain data in order to perform the service.

Pipedrive Ltd. (EU) Mustamäe tee 3a, Tallinn 10615, Estonia: User data (name, email of staff) for CRM purposes.

Mixpanel Inc. (USA, EU-based servers), One Front Street, Floor 28 San Francisco, CA 94111: Anonymized analytics tool (manages IP addresses). Mixpanel never keeps the IP addresses, but these are deleted as soon as the analysis is created (less than a second).

Hotjar Ltd. (EU) Dragonara Business Center 5th Floor, Dragonara Road, Paceville St Julian's STJ 3141 Malta: Analytics tools for website quality improvement (IP address).

Startdeliver AB (EU), Kungsgatan 30, 111 56 Stockholm: Customer Success tool (name, email, role, IP address on stakeholders, not students and teachers).
